Terms of Service

This agreement
These terms cover your use of TributesForever. By creating an account, creating a memorial, or leaving a tribute, you agree to them. The Privacy Policy explains how we handle information and forms part of this agreement.
Your account
- Give accurate details and keep your email address current - it is how we verify who you are and how memorial access requests reach you.
- You are responsible for what happens under your account. Keep your password to yourself and tell us if you think someone else has it.
- Accounts are for adults. If you are under 16, please ask an adult to create the memorial.
Creating a memorial
When you create a memorial you confirm that:
- the person it commemorates has actually died;
- you have a genuine connection to them, or the family's blessing to set the page up on their behalf;
- the details you publish are accurate as far as you know; and
- you have the right to publish the photographs and documents you upload, and to name the living people you name.
Please be thoughtful about living people. A family tree or a tribute can identify someone who never agreed to appear on a public page, and they can ask us to remove it.
Who owns what you publish
You keep ownership of the words and photographs you upload. We do not claim them.
You give us permission to store, reproduce and display that material for the purpose of running the service - showing the memorial to whoever the visibility settings allow, generating resized copies of images, and producing link previews when a page is shared. That permission is limited to operating the site, lasts only while the material is on it, and ends when the memorial is deleted. We will not use it for advertising or sell it to anyone.
What is not allowed
Do not use TributesForever to:
- create a memorial for someone who has not died, or impersonate the deceased, their family, or anyone else;
- publish material that is abusive, harassing, defamatory, hateful, or intended to distress a grieving family;
- publish someone else's private information, or photographs you have no right to use;
- advertise, solicit, or send unwanted commercial messages through tributes or access requests;
- attempt to reach private memorials you have not been granted access to, or to disrupt, probe or overload the service;
- collect other people's details from the site by automated means.
Managers and ownership
Every memorial has one owner, who may invite others to help as an admin, editor, or gallery curator. Those roles are enforced, not advisory: an editor cannot review what visitors submit, and a gallery curator can only add photographs.
Ownership can be offered to someone else and moves only when they accept. The outgoing owner chooses whether to stay on as an admin or step away. Where two people disagree about who should control a memorial, we will generally follow the account that created it, but we may ask for evidence of a closer connection to the family and decide accordingly.
Removal and suspension
We would much rather leave families alone. But we may remove content, unpublish a memorial, or suspend an account where we reasonably believe these terms have been broken, where we are required to by law, or where a memorial is causing serious harm to a bereaved family.
Where we can, we will tell the owner first and give them a chance to put it right. If you believe we have got it wrong, email us and we will look again.
About the word "forever"
The name reflects our intention, and we think you deserve a straight answer rather than a marketing promise. We aim to keep memorials online indefinitely and to give long notice if that ever has to change. We cannot literally guarantee perpetuity: no company can, and we would rather say so than imply otherwise.
If we ever have to shut the service down, we will give account holders as much notice as we can and a way to download their memorials before it closes. Keep your own copies of photographs that matter to you.
Fees
Creating and publishing a memorial is free while we are getting started. If you publish during this period that memorial stays free permanently — we will not come back later and bill you for a page you were told was free.
When we do begin charging it will be a one-time fee of KSh 1,000 per memorial, paid once at the point of publishing. It is not a subscription. There is nothing to renew and nothing that can lapse.
A memorial is never taken offline because of money. There is no recurring charge to miss, so nothing you build here can be lost by forgetting to pay. Reading and visiting a memorial is always free for everyone, including leaving tributes and lighting candles.
We will give account holders clear notice by email before introducing a charge for anything that is free today.
Ending this agreement
You can close your account at any time from account settings. Memorials you share with other managers stay with them. Memorials only you could manage are hidden immediately and permanently deleted after 30 days, so contact us within that window if you change your mind.
We may end this agreement where the conduct rules above have been seriously or repeatedly broken.
Disclaimers and liability
TributesForever is provided as it is. We work to keep it available and accurate, but we do not warrant uninterrupted or error-free operation, and we are not responsible for the content families and visitors publish.
To the extent the law allows, we are not liable for indirect or consequential loss, or for loss of content you have not kept your own copy of. Nothing here limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.
Governing law
This agreement is governed by the laws of Kenya, and its courts have jurisdiction over any dispute. If you are a consumer, this does not remove protections you have under the law of the country you live in.
